1. These terms

These terms are an agreement between you and SHINMEI LLC, a company registered in Osaka Prefecture, Japan about your use of the NuvoTube application and the nuvotube.com website. By installing or using NuvoTube you accept them. If you do not accept them, do not use the app.

2. What NuvoTube is

NuvoTube is a video player for Android. It offers background playback, a floating window, fullscreen viewing and a choice of video quality, depending on the video and your device. It is free to use and does not require an account.

3. What NuvoTube is not

NuvoTube is an independent application. It is not affiliated with, endorsed by, sponsored by or operated by YouTube, Google or any other video platform, and no such relationship should be inferred from the app, this website or their names.

4. Your responsibilities

• Use NuvoTube only in ways that are lawful where you are.
• Respect the rights of the people who own the content you play, and the terms of the services that host it.
• Do not use the app to infringe copyright or any other right.
• Do not attempt to interfere with, overload, reverse engineer or circumvent the security of the app or our services, except where the law expressly allows it.
• You are responsible for your own data charges and for keeping your device secure.

5. Content

NuvoTube does not host, upload or supply video content, and we do not control what the services it plays from make available. Responsibility for content rests with whoever provides it. If you believe content reached you through the app in breach of your rights, contact us at [email protected] and we will respond to properly made notices.

6. Availability of features

Features such as background playback and the floating window depend on the video source, on your device and on permissions you grant, and may not be available for every video. We may change, suspend or withdraw features, and we may stop offering the app, without being liable to you for doing so.

7. Installing the app

You may install NuvoTube from Google Play or from the APK published at nuvotube.com. Install only from these sources: we cannot vouch for builds distributed anywhere else, and modified copies may be unsafe.

8. Intellectual property

The NuvoTube name, logo, application and website are owned by SHINMEI LLC, or used under licence. These terms give you a personal, non-exclusive, revocable licence to use the app for your own, non-commercial purposes, and nothing more. Open-source components, if any, remain under their own licences.

9. No warranty

NuvoTube is provided “as is” and “as available”. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose. Some jurisdictions do not permit these exclusions, and where that is so this clause applies only as far as it legally can.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost data or lost profits arising from your use of NuvoTube. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are unaffected.

11. Ending use

You may stop using NuvoTube at any time by uninstalling it. We may suspend or end your access if you breach these terms or use the app unlawfully.

12. Changes to these terms

We may update these terms when the app or the law changes. The effective date above shows the current version, and continuing to use the app after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Japan, without affecting any mandatory consumer protection you have where you live.
